Note: Hello Mr. Oldani, My wife and I purchased a new townhome located in the Townes of Leighlinbridge subdivision in Manhattan from Zausa Homes on April, 26th 2007. The property was new construction and we moved in upon completion. We signed a tax proration agreement at the closing and we learned upon issuance of the 2007 tax bill that Zausa neglected to pay the 2006 taxes, those taxes were subsequently sold, and a tax lien was placed on our property. Obviously we were unaware of the tax issue or we would have never purchased the home. After many months and calls to Zausa, the Will County Clerk, etc, we decided to pay the $3,945.89 in fear of losing our home. I read an article in the Chicago Tribune today involving a woman's similar problem regarding her developer failing to pay back taxes on her property. Her assessor's office issued a certificate of error, relieving her of the tax debt. The article states that the "spokesman from the assessor's office said that his office excuses property owners from back taxes if they can prove they are a bona fide purchaser, essentially meaning he or she bought the property without knowledge that previous taxes were owed". Can you please tell me if this is something that would apply to us? I can provide a copy of the tax proration agreement, a copy of the official check used to pay the back taxes, and a receipt from the Will County Clerks office. It was extremely difficult for my wife and I to pay close to $4000 in back taxes for a property that we did not live in and wasn't even built.
